Data Controller<\/h2>\n\n<p>\n<strong>from9to10 S.r.l.<\/strong><br\/>Via Moretto da Brescia 22, 20133 Milan (MI), Italy<br\/>VAT and Tax ID No. 14551150965<br\/>Email: <a href=\"mailto:privacy@from9to10.com\">privacy@from9to10.com<\/a>\n<\/p>\n\n\n<h2>2. Scope of this Notice and Privacy Roles<\/h2>\n\n<p>\nfrom9to10 may process personal data under different roles depending on the specific activity.\n<\/p>\n\n<h3>2.1. from9to10 as Data Controller<\/h3>\n\n<p>\nfrom9to10 acts as Data Controller when it independently determines\nthe purposes and means of processing. This applies, in particular, to: \n<\/p>\n\n<ul>\n    <li>management of the from9to10.com website;<\/li>\n    <li>contact requests, information requests, quotes, and demo requests;<\/li>\n    <li>creation and management of platform accounts;<\/li>\n    <li>management of relationships with customers, prospects, partners, and suppliers;<\/li>\n    <li>administrative, accounting, and contractual management;<\/li>\n    <li>user assistance and support;<\/li>\n    <li>system security and prevention of improper use;<\/li>\n    <li>analysis of website and platform usage;<\/li>\n    <li>sending informational or marketing communications, where applicable and on the relevant legal basis.<\/li>\n<\/ul>\n\n<h3>2.2. from9to10 as Data Processor<\/h3>\n\n<p>\nWhen a customer uses the from9to10 platform or related services to process\npersonal data of its own users, customers, prospects, employees, collaborators, or other individuals,\nthe customer determines the purposes of processing and acts as\n<strong>Data Controller<\/strong>, while from9to10 processes such data on behalf of the customer\nas <strong>Data Processor pursuant to Article 28 GDPR<\/strong>.\n<\/p>\n\n<p>\nThis may include, by way of example, personal data contained in materials provided\nby the customer, in uploaded documents, in analyzed websites, in editorial content,\nin linked social media accounts, in integrated CMS or CRM systems, as well as data\ncollected through lead generation features.\n<\/p>\n\n<p>\nSuch processing is governed by the Data Processing Agreement (the &#8220;DPA&#8221;) entered into\nbetween from9to10 and the customer.\n<\/p>\n\n\n<h2>3. Categories of Personal Data Processed<\/h2>\n\n<p>\nDepending on the features used, from9to10 may process the following categories of data.\n<\/p>\n\n<h3>3.1. Identification and Contact Data<\/h3>\n\n<ul>\n    <li>first and last name;<\/li>\n    <li>email address;<\/li>\n    <li>phone number, where provided;<\/li>\n    <li>company, organization, and professional role;<\/li>\n    <li>information contained in communications sent to from9to10.<\/li>\n<\/ul>\n\n<h3>3.2. Account and Platform Data<\/h3>\n\n<ul>\n    <li>identifiers of the user and their organization;<\/li>\n    <li>credentials and information necessary for authentication;<\/li>\n    <li>roles and permissions;<\/li>\n    <li>project configurations, preferences, and settings;<\/li>\n    <li>information relating to the use of platform features;<\/li>\n    <li>technical and security logs.<\/li>\n<\/ul>\n\n<h3>3.3. Technical and Browsing Data<\/h3>\n\n<ul>\n    <li>IP address;<\/li>\n    <li>device type, browser, and operating system;<\/li>\n    <li>date and time of access;<\/li>\n    <li>pages visited and features used;<\/li>\n    <li>application events;<\/li>\n    <li>information relating to sessions and interactions with the website or platform;<\/li>\n    <li>cookies and other online identifiers, as set out in the Cookie Policy.<\/li>\n<\/ul>\n\n<h3>3.4. Materials and Content Provided by the Customer<\/h3>\n\n<p>\nThe platform allows users to enter, import, link, index, and analyze\ninformation necessary for content production and management, including:\n<\/p>\n\n<ul>\n    <li>documents, texts, presentations and other materials;<\/li>\n    <li>editorial and multimedia content;<\/li>\n    <li>information relating to brands, products, services, markets, competitors and buyer personas;<\/li>\n    <li>content originating from the client&#8217;s website or other sources indicated by the client;<\/li>\n    <li>data originating from CMS, CRM and connected services;<\/li>\n    <li>content intended for publication on websites and social networks;<\/li>\n    <li>any personal data present in the materials or sources analyzed.<\/li>\n<\/ul>\n\n<p>\nThe client is responsible for the lawfulness of the data and materials made available\nto from9to10 and must ensure it has the legal bases necessary for their processing.\n<\/p>\n\n<h3>3.5. Data from publicly accessible sources<\/h3>\n\n<p>\nAs part of the analysis, research and knowledge base construction functionalities,\nthe platform may analyze publicly accessible online information, including web pages\nindicated by the client or relevant to the configured project.\n<\/p>\n\n<p>\nSuch information may incidentally include personal data already publicly\navailable. from9to10 processes it exclusively to the extent necessary for the provision\nof the service and according to the applicable privacy role. \n<\/p>\n\n\n<h2>4. Commercial communications and newsletters<\/h2>\n\n<p>\nfrom9to10 may send newsletters, product updates and commercial communications\nwhen it has a suitable legal basis.\n<\/p>\n\n<p>\nWhere required by law, such communications are sent exclusively\nwith the prior consent of the data subject.\n<\/p>\n\n<p>\nCreating an account on the platform or submitting a contact request\n<strong>does not automatically result in subscription to promotional communications<\/strong>.\n<\/p>\n\n<p>\nIn the cases permitted by Art. 130(4) of Legislative Decree 196\/2003, from9to10 may use\nthe email address obtained in connection with a relationship with a client for communications\nrelating to its own similar services, always ensuring the possibility to opt out\nfree of charge and at any time.  \n<\/p>\n\n\n<h2>6. Use of Artificial Intelligence systems<\/h2>\n\n<p>\nThe from9to10 platform uses Artificial Intelligence systems and language models\nto support activities such as source analysis, research, editorial planning,\ngeneration, transformation, optimization and verification of content.\n<\/p>\n\n<p>\nThe platform&#8217;s architecture may use various Artificial Intelligence\ncomponents and models depending on the activity requested.\n<\/p>\n\n<p>\nData and materials provided by the client may therefore be transmitted to the\ntechnological services used by the platform to the extent necessary to perform the\nspecific feature.\n<\/p>\n\n<p>\nWhen such materials contain personal data processed on behalf of the client,\nfrom9to10 acts on the client&#8217;s instructions and in compliance with the applicable DPA.\nAny providers involved in the processing are managed in accordance\nwith Art. 28 GDPR and the provisions applicable to international transfers. \n<\/p>\n\n<p>\nThe platform is not designed for the systematic processing of special categories\nof personal data under Art. 9 GDPR. The client is therefore advised not to enter\nhealth, biometric, racial or ethnic origin, political opinion,\nreligious or philosophical belief, sex life or sexual orientation data,\nunless such processing has been expressly agreed and is legally permitted.  \n<\/p>\n\n<p>\nfrom9to10&#8217;s features are intended to support editorial and marketing activities.\nThey are not used to make decisions based solely on automated processing that produce\nlegal effects or similarly significant effects on individuals\nunder Art. 22 GDPR. \n<\/p>\n\n\n<h2>7. Knowledge base, RAG, and source analysis<\/h2>\n\n<p>\nfrom9to10 may build an information base related to the client&#8217;s projects using\ncontent provided by the client, documents, websites, editorial materials, and other sources\nindicated or authorized.\n<\/p>\n\n<p>\nInformation may be indexed and used through Retrieval-Augmented\nGeneration (&#8220;RAG&#8221;) techniques and similar information search and retrieval\nsystems.\n<\/p>\n\n<p>\nThese features allow the platform&#8217;s agents to use the client&#8217;s information\nassets as context for content production and review.\n<\/p>\n\n<p>\nIf the sources contain personal data, such data is processed solely\nfor purposes related to the provision of the service and in accordance with the privacy role\napplicable to from9to10.\n<\/p>\n\n\n<h2>8. Integrations with CMS, CRM, and other services<\/h2>\n\n<p>\nThe platform may be connected, at the client&#8217;s request, to CMS, CRM,\nthird-party platforms and services, including, by way of example,\nWordPress, WooCommerce, HubSpot, Shopify, Liferay, and Magnolia.\n<\/p>\n\n<p>\nDepending on the integration activated, from9to10 may process:\n<\/p>\n\n<ul>\n    <li>identifiers of the connected account;<\/li>\n    <li>authentication tokens and API authorizations;<\/li>\n    <li>pages, articles, images, and other content;<\/li>\n    <li>metadata relating to content and its publication;<\/li>\n    <li>technical data necessary for synchronization between systems;<\/li>\n    <li>any personal data present in the connected systems, to the extent necessary for the requested feature.<\/li>\n<\/ul>\n\n<p>\nThe connection is made at the client&#8217;s initiative and the authorizations are\nused solely to provide the requested features.\n<\/p>\n\n<p>\nThe connected external services also operate in accordance with their respective terms of service\nand privacy notices.\n<\/p>\n\n\n<h2>9. Social media management and publishing \u2013 Mixpost<\/h2>\n\n<p>\nfrom9to10 uses <strong>Mixpost<\/strong> as a software component for managing,\nscheduling, and publishing content on social networks connected to the platform.\n<\/p>\n\n<p>\nMixpost is used in <strong>self-hosted<\/strong> mode, within the infrastructure\nmanaged by from9to10. The software orchestrates the connection of social accounts\nand publishing activities without the mere use of the software automatically resulting\nin the content being disclosed to Mixpost&#8217;s developer. \n<\/p>\n\n<p>\nWhen a client connects a social account, the following may be processed:\n<\/p>\n\n<ul>\n    <li>identifiers of the connected account, profile, or page;<\/li>\n    <li>name and public information of the account;<\/li>\n    <li>access tokens and OAuth or equivalent authorizations;<\/li>\n    <li>technical identifiers provided by the social network;<\/li>\n    <li>text, images, and other content intended for publication;<\/li>\n    <li>dates, times, and status of publications;<\/li>\n    <li>information and metrics made available by the social network&#8217;s APIs;<\/li>\n    <li>any comments, interactions, or other data made available by the APIs, when the relevant feature is activated.<\/li>\n<\/ul>\n\n<p>\nThe social network credentials are not requested directly by from9to10\nwhen the connection takes place via OAuth: the user authorizes the connection\nthrough the procedures made available by the social network, and from9to10 receives\nthe necessary tokens and technical authorizations.\n<\/p>\n\n<p>\nThe data is used exclusively to carry out the activities requested by the client,\nsuch as management, scheduling, publication and monitoring of content.\n<\/p>\n\n<h3>LinkedIn<\/h3>\n\n<p>\nWhen the client connects a LinkedIn account or page, the data necessary\nto perform the requested operations is shared with LinkedIn.\nFor users located in the European Union and the European Economic Area,\nthe LinkedIn service is managed by <strong>LinkedIn Ireland Unlimited Company<\/strong>,\nwhich processes data in accordance with its own privacy policy.\n<\/p>\n\n<h3>Facebook and Instagram<\/h3>\n\n<p>\nWhen the client connects a Facebook or Instagram account, the data necessary\nto perform the requested operations is shared with Meta services.\nFor users in the European Region, the relevant services are managed by\n<strong>Meta Platforms Ireland Limited<\/strong>, in accordance with Meta&#8217;s terms and\nprivacy policy.\n<\/p>\n\n<p>\nAny additional social networks that can be connected to the platform are subject\nto the terms and privacy policies of their respective providers.\n<\/p>\n\n\n<h2>10. Lead generation and CRM integration<\/h2>\n\n<p>\nIf the client activates the relevant features, from9to10 may provide\ntools for collecting contacts through content published on the client&#8217;s website,\nsuch as forms, popups, paywalls or similar tools.\n<\/p>\n\n<p>\nIn such cases, the <strong>client acts as Data Controller<\/strong> for the data\ncollected through its own website and determines the purpose, legal basis and content\nof the notice provided to users.\n<\/p>\n\n<p>\nfrom9to10 processes such data on behalf of the client in its capacity as\n<strong>Data Processor<\/strong> and may transmit it to the CRM or other\nsystems specified by the client.\n<\/p>\n\n<p>\nWhere provided for by the service, data submitted by users may be supplemented\nwith professional information or information relating to their employer, obtained\nfrom legitimately usable sources, as agreed with the client.\n<\/p>\n\n\n<h2>11. Platform hosting \u2013 Hetzner<\/h2>\n\n<p>\nThe main application components of the platform and the data uploaded or generated therein\nare hosted on infrastructure made available by\n<strong>Hetzner Online GmbH<\/strong>.\n<\/p>\n\n<p>\nThe infrastructure used by from9to10 is located within the European Union,\nat Hetzner data centers located in <strong>Falkenstein and\/or Nuremberg, Germany<\/strong>,\ndepending on the specific infrastructure used.\n<\/p>\n\n<p>\nThe application software is installed and managed by from9to10.\nApplication access and encryption keys are managed under the control\nof from9to10. Any platform backups are stored on\nHetzner infrastructure located within the European Union. \n<\/p>\n\n<p>\nFor more information:\n<a href=\"https:\/\/www.hetzner.com\/legal\/privacy-policy\/\" target=\"_blank\" rel=\"noopener noreferrer\">Hetzner Privacy Policy<\/a>.\n<\/p>\n\n\n<h2>12. Google Cloud<\/h2>\n\n<p>\nfrom9to10 uses <strong>Google Cloud<\/strong> services as part\nof the platform&#8217;s technological infrastructure and features.\n<\/p>\n\n<p>\nFor contractual relationships regarding Google Cloud services for Italian clients,\nthe relevant contracting company may be <strong>Google Cloud Italy S.r.l.<\/strong>,\nin accordance with the contractual terms applicable to the relevant account.\n<\/p>\n\n<p>\nDepending on the specific feature used, technical data,\ncontent and information necessary for the processing required by the platform may be processed.\n<\/p>\n\n<p>\nGoogle Cloud is among the providers used by from9to10 for the processing\nof data within the platform&#8217;s services, in accordance with the applicable contractual\nand data protection agreements.\n<\/p>\n\n<p>\nFor more information:\n<a href=\"https:\/\/cloud.google.com\/privacy\" target=\"_blank\" rel=\"noopener noreferrer\">Google Cloud Privacy<\/a>.\n<\/p>\n\n\n<h2>13. Google Workspace<\/h2>\n\n<p>\nfrom9to10 uses <strong>Google Workspace<\/strong> for business activities such as\nemail, document management, storage and collaboration.\n<\/p>\n\n<p>\nAs part of these services, data relating to clients, prospects,\npartners and suppliers, contained in communications or documents necessary\nfor managing the relationship with from9to10, may be processed.\n<\/p>\n\n<p>\nThe processing is subject to the data processing agreements and terms\napplicable to Google Workspace services.\n<\/p>\n\n<p>\nFor more information:\n<a href=\"https:\/\/workspace.google.com\/terms\/privacy.html\" target=\"_blank\" rel=\"noopener noreferrer\">Google Workspace Privacy<\/a>.\n<\/p>\n\n\n<h2>14. PostHog \u2013 platform usage analysis<\/h2>\n\n<p>\nfrom9to10 uses <strong>PostHog<\/strong> to analyze the operation\nand usage of the platform, identify technical issues, and understand\nhow the various features are used.\n<\/p>\n\n<p>\nThe data processed may include:\n<\/p>\n\n<ul>\n    <li>technical identifiers;<\/li>\n    <li>events generated during use of the platform;<\/li>\n    <li>pages and features used;<\/li>\n    <li>browser and device information;<\/li>\n    <li>technical information necessary for error diagnosis and service improvement.<\/li>\n<\/ul>\n\n<p>\nfrom9to10 configures the service according to data minimization criteria,\nlimiting the data processed to what is necessary for technical\nand product analysis purposes.\n<\/p>\n\n<p>\nFor more information:\n<a href=\"https:\/\/posthog.com\/privacy\" target=\"_blank\" rel=\"noopener noreferrer\">PostHog Privacy Policy<\/a>.\n<\/p>\n\n\n<h2>15. Brevo \u2013 contact and communication management<\/h2>\n\n<p>\nfrom9to10 uses <strong>Brevo<\/strong>, a service previously known as\nSendinblue, for managing contacts, communications, automations,\nand, where applicable, for sending newsletters and marketing communications.\n<\/p>\n\n<p>\nAs part of the use of Brevo, the following may be processed:\n<\/p>\n\n<ul>\n    <li>first and last name;<\/li>\n    <li>email address;<\/li>\n    <li>phone number, where provided;<\/li>\n    <li>company and professional role;<\/li>\n    <li>information relating to the relationship with from9to10;<\/li>\n    <li>communication preferences;<\/li>\n    <li>information relating to the sending, delivery, and interaction with communications sent;<\/li>\n    <li>technical information necessary for managing the service.<\/li>\n<\/ul>\n\n<p>\nBrevo is used both for operational communications with customers,\nprospects, and users, and, where a suitable legal basis exists,\nfor newsletters and marketing communications.\n<\/p>\n\n<p>\nPromotional communications are sent in compliance with applicable\nregulations and, where necessary, subject to the data subject&#8217;s consent.\nThe data subject may withdraw consent or object to receiving\nmarketing communications at any time by using the unsubscribe link\nincluded in the communications or by contacting from9to10.\n<\/p>\n\n<p>\nAccording to information made available by Brevo, the databases relating\nto the services are hosted on infrastructure located within the European Union.\nBrevo processes data in accordance with the applicable contractual\nand data protection agreements.\n<\/p>\n\n<p>\nFor more information:\n<a href=\"https:\/\/www.brevo.com\/legal\/privacypolicy\/\" target=\"_blank\" rel=\"noopener noreferrer\">Brevo Privacy Policy<\/a>.\n<\/p>\n\n\n<h2>16. Microsoft Clarity<\/h2>\n\n<p>\nfrom9to10 may use <strong>Microsoft Clarity<\/strong>, a service provided\nby Microsoft, to understand how users interact with the site\nand\/or the platform&#8217;s interfaces and to improve the user experience.\n<\/p>\n\n<p>\nClarity may collect information relating to how pages are viewed\nand to user interactions, such as clicks, movements, scrolling,\nand navigation sequences, and may enable the generation of heatmaps\nand session recordings.\n<\/p>\n\n<p>\nfrom9to10 configures the service to limit the collection of information\nthat is not necessary and to avoid, as far as possible, recording content\nthat is confidential or entered into sensitive fields.\n<\/p>\n\n<p>\nFor users located in the European Economic Area, Microsoft Clarity\nis activated, in modes requiring cookies or similar\ntracking tools, <strong>only after consent has been obtained<\/strong>.\n<\/p>\n\n<p>\nProcessing carried out by Microsoft is also governed\nby the privacy policy and terms applicable to Microsoft services.\n<\/p>\n\n<p>\nFor more information:\n<a href=\"https:\/\/privacy.microsoft.com\/privacystatement\" target=\"_blank\" rel=\"noopener noreferrer\">Microsoft Privacy Statement<\/a>.\n<\/p>\n\n\n<h2>17. Matomo Analytics<\/h2>\n\n<p>\nfrom9to10 uses <strong>Matomo<\/strong> to collect statistical information\nabout website usage and analyze its performance.\n<\/p>\n\n<p>\nMatomo may process information such as:\n<\/p>\n\n<ul>\n    <li>pages visited;<\/li>\n    <li>date and time of the visit;<\/li>\n    <li>origin of the visit;<\/li>\n    <li>technical information about the browser and device;<\/li>\n    <li>identifiers necessary to distinguish visits and sessions.<\/li>\n<\/ul>\n\n<p>\nWhen configured with cookies, Matomo may use identifiers such as\n<code>_pk_id<\/code>, <code>_pk_ses<\/code> and <code>_pk_ref<\/code>.\n<\/p>\n\n<p>\nStatistical cookies are activated in accordance with the preferences\nexpressed by the user through the consent management system,\nexcept in cases where the specific configuration may legitimately\nbenefit from the exemptions provided for by applicable law.\n<\/p>\n\n\n<h2>18. Google Tag Manager<\/h2>\n\n<p>\nThe site uses <strong>Google Tag Manager<\/strong>, a service provided by Google,\nfor the centralized management of tags and scripts present on the site.\n<\/p>\n\n<p>\nGoogle Tag Manager allows other services to be activated and managed,\nincluding statistical and analytics tools.\n<\/p>\n\n<p>\nThe use of Google Tag Manager does not change the legal basis required\nfor the individual tools activated through it. Tags that require the user&#8217;s\nconsent must therefore remain disabled until such consent\nis given. \n<\/p>\n\n\n<h2>19.
